1. Introduction and Acceptance
Welcome to CourtesyBus.app, operated under the registered business name COURTESY BUS APP (ABN 13 802 730 350) ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our business-to-business (B2B) fleet management platform that enables clubs and organizations to manage their courtesy bus operations.
By accessing or using our service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, you may not access our service. These Terms apply to all visitors, users, and others who access or use the service.
Our service is provided to clubs, businesses, and organizations that require fleet management capabilities, and is used by their authorized staff members. Where an Organization enables our online booking widget, that Organization's customers may submit booking requests directly through it. All transportation services are provided by the Organization, not by us: we supply the software platform only, and our contractual relationship is with the Organization.
2. Definitions
For the purposes of these Terms of Service:
- "Service" refers to the CourtesyBus.app fleet management platform
- "Organization" refers to the club, business, or entity that subscribes to our service
- "Authorized User" refers to staff members granted access by the Organization
- "Customer Data" refers to booking and passenger information entered by Authorized Users, uploaded in bulk as customer lists, or submitted by customers through an Organization's online booking widget
- "We", "Us", "Our" refers to CourtesyBus.app
- "Member" refers to individuals associated with an Organization who are eligible to use transportation services
3. Service Description
CourtesyBus.app provides a cloud-based fleet management platform that includes:
- User account management for authorized staff
- Customer booking and trip management tools
- Fleet scheduling and operational coordination
- Reporting and analytics features
- An online booking widget that Organizations may embed on their website to accept customer booking requests
- A companion mobile application (Courtesy Bus Driver) for authorized drivers to view assigned runs, update run status, and optionally share vehicle location
- Customer support and technical assistance
As an Organization, you may:
- Create and manage fleet schedules and routes
- Add and manage authorized staff users
- Process customer bookings and manage passenger information
- Monitor fleet operations and generate reports
- Configure booking parameters and operational settings
- Set administrative rights and permissions
As an Authorized User, you may:
- Process customer bookings within organizational parameters
- Manage passenger information and trip details
- Access reporting and analytics tools
- Coordinate with fleet operations
- Receive notifications about bookings and operations
We reserve the right to modify, suspend, or discontinue any part of our service at any time with reasonable notice to subscribers.
4. Account Registration and Eligibility
To use our service, you must:
- Be at least 18 years of age
- Be an authorized representative of a club, business, or organization
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Immediately notify us of any unauthorized use of your account
You are responsible for all activities that occur under your account. We may refuse service, suspend or terminate accounts, or cancel subscriptions where we have reasonable grounds to do so, in accordance with Section 13 (Termination). You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
5. Subscription and Payment Terms
Our service operates on a subscription basis with the following terms:
- Subscription fees are billed in advance on a recurring basis (monthly or annually)
- Fees include platform access, data storage, and standard customer support
- Payment processing is handled through Stripe
- Fees are non-refundable except as expressly provided in these Terms or as required by law, including the Australian Consumer Law
- We may change subscription prices with at least 30 days notice; if you do not accept a price change, you may cancel your subscription before it takes effect
- Failure to pay fees may result in service suspension or termination
Current pricing is available on our website. Subscription renewals are automatic unless cancelled. You may cancel your subscription at any time through your site billing settings or by contacting support.
6. User Responsibilities and Acceptable Use
You agree to use our service responsibly and in accordance with these terms. You must not:
- Use the service for any unlawful purpose or in violation of applicable laws
- Attempt to gain unauthorized access to our systems or other users accounts
- Interfere with or disrupt the service or servers
- Use the service to harass, abuse, or harm others
- Share your account credentials with unauthorized individuals
- Reverse engineer, decompile, or attempt to extract source code
- Use automated systems to access the service without permission
You are responsible for ensuring that all customer data entered into our platform is lawfully obtained, and used in compliance with applicable privacy laws. This applies equally to customer lists uploaded in bulk: you warrant that you are authorized to provide those individuals' details to us, including details of individuals who have not themselves interacted with the platform, and that you have met any notice or consent obligations owed to them under applicable privacy laws.
7. Booking Management and Operational Policies
Organizations using our platform agree to:
- Maintain appropriate authorization levels for staff users
- Comply with all applicable transportation and safety regulations
- Use the platform solely for legitimate business purposes
- Pay all fees and charges associated with the Service in a timely manner
8. Data Ownership and Privacy
You retain ownership of all customer data and operational information that you enter into our platform. We process this data solely to provide our service as outlined in our Privacy Policy.
We implement appropriate technical and organizational measures to protect your data, including:
- Encryption of data in transit
- Access controls and user authentication
- Regular security monitoring and updates
- Secure backup and disaster recovery procedures

9. Intellectual Property Rights
The CourtesyBus.app platform, including its software, design, text, graphics, and other content, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our service during your subscription period.
You may not copy, modify, distribute, sell, or lease any part of our service or included software, nor may you reverse engineer or attempt to extract the source code unless permitted by law.
You retain any rights to data you submit to the Service. By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with providing and promoting the Service.
10. Service Availability and Maintenance
We strive to maintain high service availability but cannot guarantee uninterrupted access. Our service may be temporarily unavailable due to:
- Scheduled maintenance and updates
- Emergency security patches
- Third-party infrastructure issues
- Network connectivity problems
- Force majeure events
We will provide reasonable notice of planned maintenance when possible and work to minimize service disruptions.
11. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Delays or disruptions in fleet management services
Our total liability to you for all claims arising out of or relating to these Terms or our service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Australian Consumer Law: Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded. Where our liability for failure to comply with a consumer guarantee can lawfully be limited, it is limited, at our option, to the resupply of the services or the payment of the cost of having the services supplied again.
Nothing in these Terms excludes or limits our liability for death, personal injury, fraud, or any other liability that cannot be excluded or limited under applicable law.
12. Indemnification
You agree to indemnify, defend, and hold us harmless from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:
- Your use of our service in violation of these Terms
- Your violation of any third-party rights
- Any data you provide that infringes intellectual property rights
- Your violation of applicable laws or regulations
This indemnity does not apply to the extent that the relevant claim, loss, or liability was caused by our negligence, wilful misconduct, or breach of these Terms.
13. Termination
Either party may terminate your subscription under the following conditions:
Termination by You:
- Cancel your subscription through site billing settings at any time. Cancelling stops billing at the end of your current billing period but does not delete your site or its data
- Delete your site through site settings. Deletion schedules the permanent removal of the site and all its data 30 days after deletion; within that window a site administrator can restore the site (or contact support to do so). After the 30 days the data no longer exists and cannot be recovered
- Contact support to request immediate account closure
- Termination takes effect at the end of your current billing period
Termination by Us:
- Immediate termination for serious violations or illegal activity
- 30 days notice for material breach of Terms after opportunity to cure
- 30 days notice for convenience or business reasons, in which case we will refund a pro-rata portion of any prepaid fees for the unused part of your subscription period
- Immediate suspension for non-payment, with termination after 7 days
Effect of Termination:
- Your access to the service will immediately cease
- We will retain your data according to our Privacy Policy
- You may request data export within 30 days of termination. If your site has been deleted, export is only possible within the 30-day recovery window — after that the data is permanently removed and no export is possible
- No refund of prepaid fees except where these Terms provide for one (such as termination by us for convenience, or non-acceptance of a price change or material change to these Terms) or where a refund is required by law, including the Australian Consumer Law
14. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from or relating to these Terms or our service shall be resolved through:
- Good faith negotiations between the parties
- Mediation if direct negotiations fail
If a dispute cannot be resolved through negotiation or mediation, the courts of Victoria, Australia have exclusive jurisdiction. Nothing in this section prevents either party from seeking urgent interlocutory relief in a court, or restricts any right you have to make a complaint to a regulator, including under the Australian Consumer Law or the Privacy Act 1988 (Cth).
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting updated Terms on our website
- Sending email notifications to registered users
- Providing in-platform notifications
If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. If you do not accept a material change, you may cancel your subscription before the change takes effect and receive a pro-rata refund of any prepaid fees for the unused part of your subscription period. Your continued use of our service after changes become effective constitutes acceptance of the updated Terms.
